How to run a FSBO calling block with it
- Print it, or open it on a second screen. Page 1 is for the first call, page 2 for everything after the first "no".
- Scrub the list first. A number on a yard sign or a listing site is not a Do Not Call exemption (see below). Remove registry numbers and anyone who has asked you not to call.
- Pick the opener by listing age. A sign that went up this week gets the buyer-first or straight-shooter opener; a listing that has sat 30 to 60 days gets the aged-FSBO opener.
- Replace every placeholder ({First Name}, {Street}, {low}, {high}, {price}) with real details, and only quote sales you have actually pulled.
- Log before the next dial. Outcome, asking price, showing count and the exact callback date. The note you don't write in the ten seconds after hanging up is the note that never exists.
- Call during the owner's evening or weekend morning. Most FSBO sellers work a day job; the best time to cold call guide has the numbers, and the calling hours guide has the legal windows by state.
Is it legal to cold call FSBO sellers?
Yes, with the Do Not Call rules in force. In 2005 the National Association of Realtors asked the FCC to treat calls to FSBO advertisers as outside those rules, and the FCC declined: a call made to offer your services to the owner is a telephone solicitation, so a number on the National Do Not Call Registry is off limits unless an exemption applies, while a call made only on behalf of a buyer you represent is not a solicitation (FCC 05-28, paragraph 15). The mechanics are in 47 CFR 64.1200: calls to homes between 8 a.m. and 9 p.m. in the owner's local time, a registry scrub no more than 31 days old, your own internal do-not-call list, and no pre-recorded or ringless voicemail without prior express written consent.
